Michael Jordan Tells Court He ‘Wasn’t Afraid’ of Nascar in Legal Battle

Michael Jeffrey Jordan, introducing himself formally in a federal courtroom on Friday, stated that his competitive side and status as a newcomer emboldened his effort with 23XI Racing to “challenge” Nascar over alleged violations of competition laws.

Team Investment and a Will to Win

The owner disclosed financial and corporate details of his 23XI team, saying he invested $40 million of his personal wealth into the Cup Series operation co-founded with business partner Curtis Polk and longtime driver Denny Hamlin.

“It fell to someone to act,” Jordan said during testimony. “I was a new person, I had no fear. I believed I could take on Nascar in its entirety. From my perspective, the sport required examination from a different view.”

The Core Dispute: Franchise System and Renewal Demands

The heart of the case involves the end of a 2016 deal where Nascar provided each team a “charter”. This system mirrors other professional sports with independent franchises, such as the NBA’s Hornets or the Carolina Panthers. The agreement was set to expire in 2024 when Nascar demanded charter membership renewals.

Jordan was on the witness stand for an hour and exited the courthouse to pandemonium, with onlookers and reporters clamoring for a view or a photo of the global icon.

Spearheading the Fight

Jordan’s 23XI is at the forefront of the push along with Front Row Motorsports for Nascar to overhaul a business model Jordan contended is unlawful to keep two hands on the wheel.

For Jordan and and Heather Gibbs, who testified before Jordan, are details from September 2024. She recounted a frantic and emotional six hours where the racing circuit told teams they must sign a contract extension. This agreement spanned 112 pages detailing team compensation and a guaranteed spot in Nascar-sponsored races.

A Refusal to Sign

Jordan explained that his team and its ally decided their only feasible option was to decline to sign that 112-page package and litigate the matter. All other teams signed the agreement.

The team owners reached out to Nascar about potential amendments or negotiations. Nascar wasn’t talking, Jordan said.

The Ultimate Motivation: Winning

But in the end, the resistance against what he saw as a unsustainable system was driven by the usual bottom line for Jordan: Winning.

“Hamlin persuaded me getting a third driver boosted our odds of winning,” he said, sharing that he purchased another franchise late in 2024 for $28m despite the uncertainty. “So I dove in.”

Heather Gibbs’ Testimony

Heather Gibbs detailed her request for permanent charters, submitted in a formal letter to Nascar. She testified the timing of the signature deadline didn’t sit well.

According to her, Joe Gibbs first tried to call and persuade Nascar against demanding signatures, but CEO Jim France refused the appeal.

“Don’t do this to us,” Gibbs recounted was the message to Nascar’s leadership. The response was, “If I wake up and I have 20 charters, that’s what I have. If I have 30, that’s the number.”
